1. Acceptance of Terms
By accessing or using the Nagomi mobile application and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
Nagomi is a platform that connects customers seeking massage services with independent massage therapists. We facilitate bookings and communications but do not directly provide massage services.
3. User Accounts
To use our services, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
4. For Customers
As a customer, you agree to:
- Provide accurate booking information and location
- Be present and available at the scheduled time
- Pay booking fees through the platform and service fees directly to therapists
- Treat therapists with respect and professionalism
- Cancel bookings with reasonable notice when possible
5. For Therapists
As a therapist, you agree to:
- Provide accurate profile information and qualifications
- Complete identity verification as required
- Maintain appropriate licenses and certifications
- Provide services as described in your listings
- Arrive on time for scheduled appointments
- Maintain professional conduct at all times
6. Payments
Booking fees are processed through PayPal and are non-refundable except in cases of therapist cancellation or no-show. Service fees are paid directly to therapists at the time of service. We are not responsible for disputes between customers and therapists regarding service fees.
7. Cancellation Policy
- Customers may cancel bookings up to 2 hours before the scheduled time for a full refund of the booking fee
- Cancellations within 2 hours may forfeit the booking fee
- Therapists who cancel may be subject to account review
8. Independent Contractors
Therapists using Nagomi are independent contractors, not employees. Nagomi does not control the manner in which therapists provide services. Therapists are responsible for their own taxes, insurance, and compliance with applicable laws.
9. Prohibited Conduct
Users may not:
- Use the service for any illegal purpose
- Harass, abuse, or harm other users
- Provide false or misleading information
- Attempt to circumvent the platform for payments
- Violate any applicable laws or regulations
- Request or offer services of a sexual nature
10. Limitation of Liability
Nagomi provides a platform connecting users and is not responsible for the actions of customers or therapists. We do not guarantee the quality, safety, or legality of services provided. Users interact at their own risk.
11. Dispute Resolution
We encourage users to resolve disputes directly. Nagomi may mediate disputes at our discretion but is not obligated to do so. Any legal disputes will be resolved through arbitration in accordance with applicable laws.
12. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Continued use of the service after changes constitutes acceptance of the new terms.
13. Termination
We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time through the app settings.
